OMB Releases Guidance for Federal Agencies to Implement OPEN Government Data Act

OMB introduces new requirements for data governance, such as the establishment of a CDO Council.

The U.S. Office of Management and Budget (OMB) has recently issued guidance to Federal agencies on implementing the Open, Public, Electronic, and Necessary (OPEN) Government Data Act, to help drive innovation in artificial intelligence and other fields, among other things. 

In a memo, OMB also introduced new requirements for data governance, such as the establishment of Chief Data Officers and a CDO Council, as well as data management, including metadata and open formats for all data assets, and transparent processes like open data plans.

The memorandum also establishes a structured approach to open data, designed to also enhance data accessibility for evidence-building,, support research, and advance government transparency and accountability, all while ensuring appropriate safeguards for privacy, confidentiality, and security.

“Federal data is a valuable national resource and a strategic asset. Expanding access and usability of Federal data and strengthening Federal agencies’ plans for data management and sharing can have a positive effect on the Federal Government and the public,” OMB said.

OMB also emphasized that public access to open government data assets can enhance transparency and accountability, foster trust and credibility, boost civic participation and community engagement, drive innovation and collaboration with the private sector and academia, improve government operations’ efficiency and effectiveness, and support evidence-building activities and data-driven decision-making.

In October last year, OMB issued new guidance for federal agencies looking to acquire artificial intelligence solutions. The memorandum on responsible AI acquisition in government instructs U.S. agencies to implement measures for managing risks, fostering competition, and facilitating information sharing within the executive branch.
